Last updated: 2026-07-18. These Terms of Service (“Terms”) govern access to https://skirack.x70.one and related Skirack product marketing content offered by Daniel Ensminger, trading as x70 (“x70”, “we”, “us”).

1. Agreement

By browsing this website, submitting a contact inquiry, or subscribing to the newsletter, you agree to these Terms and our Privacy Policy. If you act on behalf of a business, you confirm you are authorized to bind that business.

2. Nature of this site

This website provides marketing information about the x70 Skirack — a modular rear bike rack for skis and snowboards — including features, development story, hardware versions, and contact channels. Content is informational unless we expressly confirm an order, quote, or purchase in writing.

Depending on your interaction, you may:

• Submit inquiries about availability, fitment, or partnerships
• Subscribe to optional email updates about Skirack

3. Product information and availability

Descriptions, renders, load-test narratives, and module statuses (e.g. production vs prototype) are provided in good faith but may change as development continues. Published specifications are indicative until confirmed in a written offer, invoice, or purchase agreement. We do not guarantee stock, shipping timelines, or bike compatibility for every frame without individual confirmation.

4. Inquiries and communications

Contact form submissions and email are used to respond to your request. You must provide accurate contact details and not misuse the form for spam or unlawful content. We may decline or ignore abusive requests.

5. Newsletter

If you subscribe, you consent to receive occasional Skirack updates. You may unsubscribe at any time via the link in the email or by contacting contact@x70.one.

6. Intellectual property

Unless otherwise stated, we retain intellectual property in site content, product designs, renders, branding, and documentation. You may not copy, redistribute, or commercially exploit that material without prior written consent, except for personal, non-commercial viewing of this site.

We do not warrant that the site will be error-free or uninterrupted, or that product outcomes (fitment, performance, or business results) are guaranteed solely from marketing materials.

9. Liability

Nothing in these Terms limits liability for intent (Vorsatz), gross negligence (grobe Fahrlässigkeit), injury to life, body, or health, fraud, or other liability that cannot be limited under German law, including under the Product Liability Act where applicable.

For slight negligence, we are liable only for breach of essential contractual obligations (Kardinalpflichten), and liability is limited to the typical, foreseeable damage.

10. Acceptable use

You may not misuse the website, attempt unauthorized access, interfere with security, scrape at abusive volumes, or use contact or newsletter features for unlawful content or spam.

11. Consumer rights

If you later purchase Skirack hardware or related services under a separate contract, mandatory consumer protections (including any applicable withdrawal rights for distance contracts) will be stated in that agreement or checkout flow. These marketing-site Terms do not by themselves create a purchase contract.

12. Governing law and disputes

These Terms are governed by the laws of the Federal Republic of Germany, excluding conflict-of-law rules. Mandatory consumer protections in your country of residence remain unaffected. Courts in Germany have jurisdiction, subject to mandatory consumer venue rules.

13. Changes

We may update these Terms. The “Last updated” date will change when we do. Continued use after changes take effect constitutes acceptance, except where your explicit consent is required.
